JUSTICE RAKESH KUMAR ORAL ORDER 24-08-2016 At the very outset, Sri Ranjan Kumar Jha, learned counsel, who was assisted by Sri Chandan Kumar Kashyap, learned counsel for the petitioners, in presence of Sri Umeshanand Pandit, learned Addl. Public Prosecutor, makes a prayer for withdrawal of the present case so far as the petitioner no.2, namely, Md. Mumtaj is concerned, so that he may appear before the court below and make a prayer for regular bail. The prayer is allowed.
The present petition stands dismissed as withdrawn so far as petitioner no.2, namely, Md. Mumtaj is concerned. It is made clear that if the petitioner appears before the court below within a period of six weeks from today and makes a prayer for
Patna High Court Cr.Misc. No.31800 of 2016 (2) dt.24-08-2016 2/2 regular bail, the learned court below without being prejudiced with this order may examine the same and pass appropriate order in accordance with law.
So far petitioner no.1, namely, Kuslum Khatun @ Kuslum Khatoon, who apprehends her arrest in Barauni P.S. Case no.81 of 2016 registered for the offence under Sections 147, 148, 149, 323, 324, 379 and 307 of the Indian Penal Code, is concerned, I have perused the materials on record. In view of facts and circumstances as well as the fact that the petitioner is a lady, let the petitioner, namely, Kuslum Khatun @ Kuslum Khatoon , in the event of her arrest or surrender within six weeks from today , be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand ) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Barauni P.S. Case No.81 of 2016, subject to conditions as laid down in Section 438(2) of the Code of Criminal Procedure.
