JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-04-2019 The petitioner apprehends his arrest in connection with Manjhagarh P.S.Case No. 238 of 2015 registered under Sections 363 and 366A of the Indian penal Code.
Allegation against the petitioner is of kidnapping the minor daughter of the informant and petitioner is not named in the FIR. Later on, his name transpired in the statement of girl recorded under Section 164 Cr.P.C.
Submission of learned counsel for the petitioner is that as a matter of fact, girl has love affair with one Murtuza Hafiz with whom she had married also but later on a dispute arise as Murtuza was already married and in his regard, a marriage certificate has been annexed as Annexure-2 series. He further submits that supervision note of the police disclosed that girl was aged about 19-20 years and there is no allegation of rape

Having heard both sides and in the facts and circumstances, as stated above, let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Gopalganj in connection with Manjhagarh P.S. Case No. 238 of 2015; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
