JUSTICE MOHIT KUMAR SHAH ORAL ORDER 15-12-2023 The present petition has been filed for modification of the order 16.05.2023, passed by this Court in Criminal Misc. No. 69775 of 2022, as far as the time granted to the petitioner to surrender before the learned court below and produce proof of deposit of a sum of Rs. 1,30,000/-, is concerned.

The learned counsel for the petitioner submits that since the petitioner was not present in the State of Bihar and was stationed at Mumbai for his livelihood, he could not deposit the aforesaid sum of Rs. 1,30,000/- within time, resulting in him not being able to surrender before the learned court below within the time stipulated

Patna High Court CR. MISC. No.81954 of 2023(2) dt.15-12-2023 2/2 by this Court, hence, a further period of two weeks be granted to the petitioner to comply with the aforesaid order of this Court dated 16.05.2023, by considering his case sympathetically.

Having regard to the facts and circumstances of the case and considering the submissions made by the learned counsel for the petitioner as also taking into account the averments made in the present petition, I deem it fit and proper to extend the time granted to the petitioner to surrender before the learned court of Chief Judicial Magistrate, Kaimur at Bhabua in connection with Bhabua P.S. Case No. 416 of 2021, as also for production of the proof of deposit of a sum of Rs. 1,30,000/- by a further period of three weeks from today.

The present petition stands disposed of on the aforesaid terms.
