2. The petitioner is apprehending her arrest in connection with Sugauli P.S. Case No. 481 of 2020 instituted for the offences under Sections 498A, 341, 323, 379 and 506 of the Indian Penal Code and Sections 3/4 of the Dowry Prohibition Act.
3. As per prosecution case, the informant was married to the co-accused Sikandar Chaudhary and she made allegation
Patna High Court CR. MISC. No.69237 of 2024(2) dt.23-10-2024 2/3 against the petitioner along with other is that they were torturing her for one motorcycle, gold chain and Rs. One lakh as dowry. She further alleged that due to non-fulfillment of dowry demand the accused persons tried to kill her by pouring kerosene oil and then she somehow managed to run away from her parental house and save herself.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. Petitioner in an old lady. He submitted that there is general and omnibus allegation against the petitioner. Petitioner being the mother of the husband of the informant, she has been implicated in this case. It is next submitted that the petitioner is a person of clean antecedent.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Motihari, East Champaran in connection with Sugauli P.S. Case
