The Petitioner apprehends his arrest in Baruraj P.S. Case No.66 of 2016 instituted for the offence under Section(s) 304-B, 201/34 Indian Penal Code pending in the Court of the Judicial Magistrate, 1st class, Muzaffarpur.

Petitioner is husband of the deceased. There is allegation that sister of the informant was done to death in her Sasural by the petitioner and other accused persons. Case diary has been received.

The learned APP has pointed out that in para 57, 58, 59 of the case diary witnesses have taken name of this petitioner. From the written report, it appears that the dead

Patna High Court Cr.Misc. No.9575 of 2017 (3) dt.27-03-2017 2/2 body was cremated without informing the family members of the deceased.

It has been submitted that compromise has taken place between the parties, but from the nature of offence and the materials available in the case diary, this Court does not find it a fit case for grant of anticipatory bail.

Prayer is rejected.

The petitioner may surrender before the Court below and seek regular bail, which shall be considered and disposed of on its own merit without being prejudiced by this order. (Sanjay Priya, J) JA/- U T
