The petitioner is languishing in jail since 20.07.2015 in a case instituted under Sections 498(A), 341, 323 and 307/34 of the Indian Penal Code.
As per allegation, it is a case of torture and assault upon the informant by the husband.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 20.07.2015. Chargesheet has been submitted in the case. There is no allegation of tampering of evidence against the petitioner. Petitioner has got no criminal antecedent. From perusal of paras 18, 19, 21 and 85 of the case diary, it is evident that the informant has performed a second
Patna High Court Cr.Misc. No.40325 of 2015 (3) dt.13-10-2015 marriage. The said fact is supported by the Qazi of the Masjid as the petitioner was working at Iraq. Petitioner has falsely been implicated in the present case.
On behalf of the State and counsel for the Informant, it has been submitted that the petitioner is named in the FIR. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Bettiah, West Champaran in connection with Sathi P.S.Case No.34 of 2014.
