1. Heard learned counsel for the petitioner and learned counsel for the State.

2. The petitioner apprehends his arrest in connection with Madhepura P.S. Case No. 115 of 2022 registered under Sections 447, 341, 323, 307, 302, 379, 504 and 506/34 of the Indian Penal Code.

3. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to ulterior motive. Further submission is that the specific allegation is against co-accused Subhash Mukhiya. The petitioner has got no criminal antecedent.

4. Having considered the facts and circumstances of the

Patna High Court CR. MISC. No.66574 of 2023(2) dt.18-10-2023 2/2 case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Chief Judicial Magistrate, Madhepura in connection with Madhepura P.S. Case No. 115 of 2022, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
