JUSTICE SUDHIR SINGH ORAL ORDER 27-09-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 315 of Explosive Substance Act, 27 of Arms Ac and 17 C.L.A.Act.

It is alleged by the informant that while he was going to Umga Mountain for the raid of the extremist along with other police officials he received information that land mines has been kept in the Jurahi Middle School. On that information he reached in the middle school then he heard 2-3 sound of firing and the extremist has been fled away in the southern side. It has been submitted on behalf of the petitioner that the petitioner is in custody since 07.11.2015. Charge sheet has been submitted in this case. There is no allegation of tampering with the

Patna High Court Cr.Misc. No.33513 of 2016 (3) dt.27-09-2016 2/2 witnesses alleged against the petitioner. No specific allegation has been made against the petitioner. General and omnibus allegation has been made against the petitioner. Other co-accused has been granted bail vide Annexure 2 to the present application. On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Aurangabad, in connection with Madanpur P.S.Case No. 233 of 2010.
