10-02-2016 Seen the report submitted by the learned lower court as well as by the Superintendent of Police, Nalanda at Biharsharif wherefrom, it is evident that fourteen witnesses have been named in the charge-sheet and all of them have been examined. That being so, the ball has gone to the court of accused. Furthermore, considering the status of the petitioner to be husband of the deceased Poonam Devi, who met with her death within five years of her marriage at her sasural and for that there happens to be specific allegation in the written report regarding demand of dowry as well as torture, I do not see, it a fit case for grant of bail.

Accordingly, the prayer for regular bail of the petitioner

Patna High Court Cr.Misc. No.40195 of 2015 (8) dt.10-02-2016 2/2 has been rejected.

In case, there happens to be active cooperation at the end of accused persons, then in that event, the learned lower court will proceed with the trial on day-to-day basis and will conclude the same within one month.
