2. The petitioner has preferred this application for grant of regular bail in connection with Bounsi P.S. Case No. 109 of 2025 dated 30.03.2025 registered for the offences punishable under Section 309(4) of the B.N.S.

3. As per the prosecution case, on 29.03.2025 when the informant was returning to home and reached near village Barmania, two unknown persons riding on a motorcycle intercepted him and snatched his backpack and purse containing Rs. 500 from his pocket and took away his motorcycle, two tabs, two biometric machines and a mobile.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case and his name has been implicated in this case only on the

Patna High Court CR. MISC. No.62972 of 2025(2) dt.18-09-2025 2/2 confessional statement of the co-accused person. Nothing has been recovered from the possession of the petitioner. The petitioner has no concern with the alleged occurrence. The petitioner has not been even put on Test Identification Parade till date. The petitioner has one criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 15.05.2025

5. Learned A.P.P. for the State has opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, and further considering the fact that the petitioner is not named in the FIR and no TIP has been done till now, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Banka in connection with Bounsi P.S. Case No. 109 of 2025.

7. The application stands allowed.
