====================================================== CORAM: HONOURABLE MR. JUSTICE AJIT KUMAR ORAL ORDER 04-09-2025 Heard Mr. Kaushal Kumar Jha, learned senior counsel for the petitioner assisted by Mr. Amish Kumar and Mr. Aakash Chaturvedi, learned counsel for the State.

The petitioner has filed the instant writ petition for the following reliefs:- "(i) For direction to the respondents concerned to consider the case of the petitioner for grant of promotion to the post of Lecturer (Senior Scale) in the old pay scale of Rs. 3000 to 5000 with effect from 09.12.1993.

(ii) For further direction to the respondents to further grant promotion to

2/4 the petitioner on the post of Lecturer (Selection Grade) in the pay scale of 12000 to 18300 with effect from 09.12.1998 under the Career Advancement Scheme (CAS), particularly taking into account that many juniors to the petitioner have been granted such promotions.

(iii) For direction to the respondents concerned to grant all consequential benefits with immediate effect on the basis of aforesaid promotions.

(iv) For direction to the respondents concerned to consider and dispose of the representation filed by the petitioner dated 01.07.2025 (Annexure-P/7).

(v) The petitioner further prays for following order/orders, direction/directions, for the following relief/reliefs which he entitled into facts and circumstances of the present case."

3. Learned counsel for the petitioner submits that despite indulgence having been given by this Court in C.W.J.C. No. 13944 of 2015 filed by the similarly situated petitioners, this Court vide order dated 02.05.2019, directed the respondent to consider the case for grant of promotion to the post of Lecturer (Senior Scale) in the old Pay Scale of Rs. 3,000 to 5,000 w.e.f. 09.12.1993 and also to grant them promotion to the post of Lecturer (Selection Grade) in the pay scale of Rs. 12,000 to 18300 w.e.f. 09.12.1998, under Career Advancement Scheme

Learned senior counsel submits that pursuant to such order, those petitioners have been granted promotion and pay-Scale attached to such post have also been accorded under Career Advancement Scheme. It has next been submitted that persons junior to the petitioner have been granted such benefits and the petitioner submitted representation to this effect, and the same is appended with the writ petition, as Annexure-P/7 at page-34, which is pending before respondent no. 2, but the said benefit for the reasons unexplained has not been extended in favour of the petitioner and, therefore, prays that his case should also be directed to be considered in the light of the decision taken pursuant to the order passed by this Court, which is annexed as Annexure-P/8 at page-37.

It is made clear that in the eligibility of this petitioner also finds favour and his case is similar to those who have been extended benefit vide Annexure-P/8, which is said to have been passed by the respondents, then similar benefit should also be extended to him by considering the representation, which is said to have been filed before Respondent no. 2.

6. The entire exercise shall be completed within a period of eight weeks from the date of production of a copy of

4/4 this order and the benefits which flows from such consideration, if any, shall be extended to this petitioner without any inordinate delay.
