Mr. Md. Arif ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2019 The petitioner apprehends his arrest in connection with Complaint Case No. 988C of 2015 registered under Sections 323, 379 and 498A of the Indian penal Code.
Allegation against the petitioner is of subjecting his wife to cruelty with demand of dowry.
Submission of learned counsel for the petitioner is that wife is residing with him and she has lodged this case falsely. Heard learned APP and learned counsel appearing on behalf of the informant who have opposed the prayer of anticipatory bail stating that she was left at the original Sasural and petitioner is not keeping her with him and she has two sons and daughter who are not being maintained by him.

No.1951 of 2019(3) dt.28-02-2019 2/2 Having heard both sides and in the facts and circumstances, as stated above, this application is disposed of with a direction to the petitioner to surrender within a period of six weeks from the date of receipt of a copy of this order, and on surrender, petitioner will be released on bail to its own satisfaction on condition that if any maintenance case is filed by the O.P. No. 2, he will co-operate in disposal of the same, if not, O.P. No. 2 will have liberty to move for cancellation of bail of petitioner in the court below concerned.
