The petitioner seeks bail in anticipation of her arrest in connection with Dumraon P.S. Case No. 441 of 2018 dated 09.11.2018 instituted for the offences under Sections 341, 323, 307 and 354 of the Indian Penal Code, under Section 12 of the POCSO Act.
The informant of this case has alleged that his brother-in-law always created disturbance in the joint house of the petitioner. On one occasion, it has been alleged that a young/minor daughter of the informant was attacked by the aforesaid brother-in-law of the informant, below her navel, as a result of which she sustained internal injuries.
The petitioner is the wife of aforesaid brother-
Patna High Court Cr.Misc. No.1973 of 2019(2) dt.15-01-2019 2/2 in-law meaning thereby that the petitioner is the younger sister-in-law of the informant.
Learned counsel for the petitioner has shown to this Court that from mere reading of the FIR, it would appear that there is a domestic dispute because of some pre-existing property dispute.
Regard being had to the aforesaid facts as also taking into account that nothing specific has been alleged against the petitioner, she is directed to be released on bail, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on her furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 1st cum Special Judge SC/ST & POCSO Act, Buxar in connection with Dumraon P.S. Case No. 441 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
