JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 20-08-2016 Heard the learned counsel for the petitioners as well as the learned counsel for the State.

In this application for anticipatory bail the petitioners apprehend their arrest for the offences punishable under sections 341, 323, 384, 504, 406, 420, 467, 468 and 471/34 of the I.P.C. On behalf of the petitioners it is submitted that the petitioners are the sons of Mukhtar Ahmad and against Mukhtar Ahmad there is allegation that he brought Shah Azaz before the informant and as per the assurance given by Mukhtar Ahmad the informant became ready to purchase the land and allegedly paid the entire consideration money and the sale deed was executed by Shah Azaz in favour of wife of the informant. Against the

Patna High Court Cr.Misc. No.33469 of 2016 (2) dt.20-08-2016 2/2 petitioners there is no specific allegation and without any fault they are being harassed.

The learned A.P.P. submits that the petitioners are also named in the FIR and investigation is still going on. In the facts and circumstances as stated above, considering that against the petitioners there is no specific allegation, they neither executed any sale deed nor they are witness and as such the petitioners, Anash Ahmad and Obesh Ahmad @ Owaish Ahmad, in case of their arrest or surrender within one month from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of. C.J.M. Saharsa in Saharsa P.S. Case No. 400 of 2016, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
