The petitioners are accused in connection with K.Nagar P.S. Case No. 374 of 2016, registered under Sections 341, 323, 324, 307, 379, 427 and 302/34 of the Indian Penal Code.

The accusation is that 12 persons named in the F.I.R. including the petitioners came at the door of the informant. At that time, Sadya wife of Md. Nakir threw solution of chilly powder at Md. Hasim, father of the informant, and Nakir gave Dabiya blow at his head. Thereafter, petitioner No.1 Md. Ansar,

Patna High Court Cr.Misc. No.9284 of 2017 (3) dt.22-03-2017 2/2 petitioner No.2 Absar and petitioner No.5 Gulsi also caused injury through lathi. When informant rushed to save then he was also assaulted by the petitioner No.3 Md. Sabir. Learned counsel for the petitioners submits that though petitioners are named in the F.I.R., but specific allegation of causing head injury to the father of the informant is against Md. Nakir, which was the cause of death of the deceased. Further submission is that petitioners have no criminal antecedent and they are in custody since 18.10.2016. Having regard to the facts and the circumstances of the case, the petitioners, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea in connection with K. Nagar P.S. Case No. 374 of 2016.
