The petitioner apprehends his arrest in Jalalpur P.S. Case No. 73 of 2019, registered for the offences punishable under Sections 307, 379 and other allied sections of the Indian Penal Code.
Prosecution case in brief is that while the informant and his cousin brother were returning from Chapra court and reached at Jalalpur Mahendra Mishra Chowk, all the accused persons including this petitioner and 15 unknown persons assaulted the informant and his brother causing injury to them and also alleged to have snatched gold chain from the neck of informant.
It is submitted that there is general and omnibus
Patna High Court CR. MISC. No.1063 of 2022(2) dt.21-07-2022 2/2 allegation of assault and no specific overt act has been alleged against this petitioner. Injuries have been found to be simple in nature. Petitioners claim clean antecedent.
Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate IX, Saran at Chapra in connection with Jalalpur P.S. Case No. 73 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
