2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 399, 400, 402, 413 and 414/34 of the Indian Penal Code, under Sections 25(1-B)(a), 26 and 35 of the Arms Act as well as under Sections 8(c) and 21(b) of the N.D.P.S. Act.

3. The case of the prosecution is that from possession of the petitioner, one country made pistol and 5.48 gm. of smack like material was recovered.

4. Learned counsel for the petitioner has submitted that the weight of the seized contraband is with paper. The contraband which has been recovered from the possession of the petitioner is just above the small quantity. The petitioner is in

Patna High Court CR. MISC. No.70413 of 2024(4) dt.02-04-2025 2/2 custody since 16.02.2024.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Bochahan P.S. Case No. 37 of 2024 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned court of Special Judge-I (NDPS) Act, Muzaffarpur.
