JUSTICE BIRENDRA KUMAR ORAL ORDER 11-05-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 342, 323, 324, 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

The petitioner is the full-brother of the informant. For dispute relating to family property, allegation against the petitioner is of firing. However, no injury was caused to anyone. The firing from the son of this petitioner caused injury at the hand of the informant.

Submission of the petitioner is that false implication is there, just to pressurize the dispute for family property. On the other hand, learned counsel for the informant

Patna High Court Cr.Misc. No.9477 of 2017 (3) dt.11-05-2017 2/2 opposed the prayer on the ground that the petitioner is accused in some other cases and is absconding in those cases. Considering the background and nature of allegation against the petitioner, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Patna City at Patna/successor Court in connection with Gaurichak Police Station Case No. 217 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
