2. The petitioner is seeking regular bail in connection with Barsoi Excise P.S. Case No. 280 of 2024 for the offences punishable under Sections 30(a) and 37 of the Bihar Prohibition and Excise Act.

3. As per allegation, the informant along with other police party reached the place of occurrence and found two persons including this petitioner in the bathroom of train. On suspicion the police searched the alleged bathroom and recovered 11.05 liters of illicit foreign liquor from roof of the alleged bathroom.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.65253 of 2024(2) dt.19-09-2024 2/2 this case. He has further submitted that no incriminating article was recovered from the possession of the petitioner. The petitioner is under custody since 03.07.2024.

5. On the other hand, the learned APP has opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances, the petitioner above-named is directed to furnish bail bond after three months from today and on doing so, the court below shall release the petitioner on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge Excise Court No.1, Katihar in connection with Barsoi Excise P.S. Case No. 280 of 2024, subject to the condition:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
