The Petitioner seeks bail in Pakridayal P.S.

Case No. 97 of 2016 instituted for the offence under Section(s) 307, 302, 120B/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that there is general and omnibus allegation against the petitioner. It is alleged against the petitioner that petitioner was standing at the spot and made firing.

It has further been submitted that one of the coaccused Ramayan Dubey has been granted bail by a coordinate Bench of this Court vide Cr. Misc. No. 14561 of 2017. One of the co-accused Dinesh Singh has already been granted anticipatory

Patna High Court Cr.Misc. No.10889 of 2017 (4) dt.25-04-2017 2/2 bail by this Court vide Cr. Misc. No. 9197 of 2017. Learned Sessions Judge has mentioned in the impugned order that in para 69 of the case diary injured Madhav Lal has stated in detail about the occurrence. The case diary has been called for to verify the statement in para 69 of the case diary. Learned A.P.P. has pointed out that there is no specific allegation against this petitioner in para 69 of the case diary.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, 5th, East Champaran at Motihari in connection with Pakridayal P.S.
