JUSTICE ASHUTOSH KUMAR ORAL ORDER 11-12-2019 The petitioner seeks bail in anticipation of his arrest in connection with Ahiyapur P.S. Case No. 1121 of 2018 dated 14.10.2018 instituted for the offences under Sections 364(A), 120(B) of the Indian Penal Code.

Since the prayer for anticipatory bail of the petitioner was earlier rejected by a Bench of this Court, I am not inclined to entertain this petition again in the absence of any new material.

On this fact being noted, learned advocate for the petitioner seeks permission to withdraw this petition

Patna High Court CR. MISC. No.72559 of 2019(2) dt.11-12-2019 2/2 in order to enable the petitioner to surrender before the Court below and regular bail on the strength of several bail orders with respect to other accused persons who have similar allegation against them.

Should such a petition be filed before the Court below, it shall be heard on its own merits without being prejudiced of the fact that the present petition has not been entertained.

The petition is dismissed as withdrawn with the liberty aforesaid.
