====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 16-05-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in connection with Mansi P.S. Case No. 224 of 2021 registered under Section 420 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 13.09.2021, is a person with clean antecedent, charge-sheet has been submitted in the case and the informant alleges that the petitioner had debited an amount of Rs. 1,60,970 from the account of Tara Devi it in between 25.04.2020 and 25.07.2020, further on account of complaint made by Tara Devi an enquiry was made on basis of which petitioner was apprehended and the petitioner confessed his case and even promised to pay the debited amount in installment till 15.10.2020 but has not paid entire amount till date.

No.72599 of 2021(2) dt.16-05-2022 2/2 Learned counsel for the petitioner based on instruction submits that the petitioner is ready and has agreed to return an amount of Rs. 1,55,000/- to Tara Devi within a period of one year from today as petitioner himself is a poor man. It is submitted that the entire amount would be returned to Tara Devi by 18.05.2023. The learned A.P.P. for the State based on submissions made by learned counsel for the petitioner does not oppose the prayer for bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, let the petitioner above named is directed to be released on provisional bail till 19.05.2023 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Mansi P.S. Case No. 224 of 2021, in the even if the amount as agreed by the petitioner is not paid to Tara Devi within the period aforesaid i.e. by 18.05.2023, the provisional bail granted to the petitioner shall be cancelled, forthwith, by the learned court below.
