====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 13-09-2019 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in a case for the offence registered under Sections 414/34 of the IPC, 25(1-b)a, 26 and 35 of the Arms Act.

The prosecution story, in brief, is on 07.04.2019 at about 5.00 P.M., in course of vehicle checking, the informant saw that two persons were seen coming on a Motorcycle. Upon seeing the police party, they stopped the Motorcycle and tried to go towards western direction. Upon suspicion, they were caught and they disclosed their name as Manish Kumar @ Monu (petitioner) and Sandeep Kumar. One loaded country made pistol and an MI Mobile Phone were recovered from possession

Patna High Court CR. MISC. No.57703 of 2019(2) dt.13-09-2019 2/3 of co-accused Sandeep Kumar. One pulsar Motorcycle bearing Registraton No. BR0-22J/8636 was recovered from the road. One loaded country made pistol and a Mobile Phone were recovered from possession of Manish Kumar (petitioner). It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since 08.04.2019. The petitioner has falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. One loaded country made pistol is alleged to have been recovered from possession of the petitioner. Other co-accused has been granted bail by this Court vide Cr. Misc. No. 51796 of 2019 vide Annexure-2 to the present application. There is no compliance of Section 100 of Cr. P.C.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bettiah, West Champaran, in connection with Bettiah Town P.S.
