The Petitioner seeks bail in Mahua P.S. Case No. 279 of 2016 instituted for the offence under Section(s) 461, 379, 511 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that petitioner is in custody since 12.08.2016. There is no recovery of any incriminating article from the personal possession of the petitioner.

From the written report, it appears that there is allegation that some unknown thieves have attempted to commit theft in the bank by cutting the grill of the Strong Room by gas

Patna High Court Cr.Misc. No.9629 of 2017 (2) dt.11-04-2017 2/2 cutter. The police chased and apprehended the petitioner. It has been submitted on behalf of the petitioner that the seizure list enclosed with the F.I.R shows that there is no recovery from the possession of this petitioner. The petitioner is said to be in custody since 12.08.2016.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahua P.S. Case No. 279 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
