JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 20-08-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Ramgarh (Nuaon) P.S. Case No. 80 of 2016 registered under Section of the 47(A) of the Excise Act and Sections 50, 51 and 63 of the Excise Amendment Act.

The accusation is that police, on receiving secret information, raided the brick kiln of the petitioner. On seeing the police, five persons succeeded to flee away but this petitioner was identified by the Chaukidar. On search, 4-5 litre of country made liquor was recovered from the room of the brick kiln. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case mere on

Patna High Court Cr.Misc. No.33301 of 2016 (2) dt.20-08-2016 suspicion. It is further submitted that the name of the petitioner has been identified by the Choukilar, in fact, the brick kiln raided by the police, is not belonging to this petitioner. It is further submitted that petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kaimur at Bhabua, in connection with Ramgarh (Nuaon) P.S. Case No. 80 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
