The petitioner apprehends his arrest in Amarpur P.S. Case No. 330/2016, registered for the offences punishable under Section 409 of the Indian Penal Code.
The allegation in brief made against the petitioner is that while the petitioner was posted as Panchayat Secretary in gram panchayat Tardih the petitioner did not hand over the records and folios with regard to appointment of panchayat teachers of the said gram panchayat. The F.I.R. itself shows that the petitioner disclosed that his predecessor did not hand over any paper to him at the time of taking charge. Therefore, he could not be able to submit any paper as per direction; even then the case is lodged. Considering the facts aforesaid and the fact that

No.13058 of 2017 (3) dt.17-04-2017 2/2 petitioner did not receive any paper or folio regarding appointment of teacher at the time of taking charge, the petitioner abovenamed, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in connection with Amarpur P.S. Case No. 330/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
