JUSTICE SUDHIR SINGH ORAL ORDER 01-10-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 406, 420, 467, 471 and 120B of the Indian Penal Code.

Allegation against the petitioner is of causing cheating and also of causing criminal breach of trust in respect of 280 bags of wheat which were entrusted to the petitioner. It has been submitted on behalf of the petitioner that he has no criminal antecedent. He is a cultivator and has no concern with the business of the informant. There is no documentary evidence to show that any such wheat was entrusted to him. He has been made accused due to mistake of fact. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest or surrender in the court below within a period of four weeks, be released on bail on
