The petitioner apprehends arrest in a case registered for the offence punishable under sections 409/34 and other ancillary sections of the Indian Penal Code.

Learned counsel for the petitioner submits that as per the FIR petitioner was credited Rs.10,95,000/- for completion of work under the Mukhya Mantri Gramin Pay Jal Nishaya Yojna. By filing supplementary affidavit, it is submitted that the informant as also the Executive Assistant vide Annexure 2 and 3 to the supplementary affidavit, have deposed in the Court below that the work in question has already been completed. Petitioner has got no criminal antecedent.

Considering the aforesaid facts of the case, prayer for

Patna High Court CR. MISC. No.2111 of 2022(3) dt.01-08-2022 2/2 bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Lakhisarai in Piparia Police Station Case No. 33 of 2020, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
