1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Harsidhi Police Station Case No. 60 of 2025, dated 31.01.2025, disclosing offences under Sections 115(2)/118/109/303(2)/351/352/3(5) of the Bhartiya Nyaya Sanhita.

3. The prosecution case, as per the First Information Report, is that on 30.01.2025, at about 07:30 PM, while the informant was returning from Harsidhi, in the meanwhile, the petitioner, along with other accused persons, intercepted the car of the informant, pulled him out from the car and assaulted him and his cousin brother. It has further been alleged that the petitioner snatched a sum of

Mr. Sharda Nand Mishra, learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present on the account of the fact that scuffle took place between the petitioner and informant on the date of occurrence. He next submits that the petitioner is a betel shopkeeper and while he was in his shop on 30.01.2025, the informant, along with others, came on four wheeler, took certain articles from the shop and did not pay the amount of those articles. When the petitioner demanded payment, the accused persons assaulted the petitioner and confined him in the house of co-accused Ajay Singh. The mother of the petitioner lodged First Information Report in this regard bearing Harsidhi Police Station Case No. 59 of 2025, which is prior in time to the present First Information Report. He further submits that the present case has been lodged in retaliation to the First Information Report lodged by the petitioner's mother against the informant and others.

5. Having regard to the submissions made on behalf of the parties and taking into consideration the nature of allegation and the fact that there is case and counter case

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate First Class, East Champaran, Motihari, in connection with Harsidhi Police Station Case No. 60 of 2025, subject to the condition laid down under Section 482 (2) of the Bhartiya Nagrik Suraksha Sanhita, 2023.
