The petitioner apprehends his arrest in Sasaram (Muif) P.S. Case No. 1254 of 2016 instituted for the offence under Section (s) 302, 120B, 34 of the Indian Penal Code and Section 27 of the Arms Act.

As per written report, there is specific allegation against co-accused Sujit Singh of causing fire arm injury to the brother-in-law of the informant on his chest, on account of which he fell down. The accused persons thereafter fled away from the place of occurrence.

It has been submitted that petitioner is not named in the First Information Report. Learned Sessions Judge

Patna High Court Cr.Misc. No.10737 of 2017 (2) dt.18-03-2017 2/2 has mentioned in the impugned order that name of this petitioner has come in paragraphs 42 and 43 of the case diary in the statement of the co-accused.

It has been mentioned in para 3 of the petition that petitioner has no criminal antecedent.

In the facts and circumstances of the case, the prayer of the petitioner for anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, above named, within six weeks from today in connection with Sasaram(Muif) P.S. Case No. 1254 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas, Sasaram, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
