The present application has been filed seeking recall of order dated 03.08.2015 passed in C.W.J.C. No. 16199 of 2008 by which the said case was dismissed for non prosecution. Learned counsel for the petitioner submits that after taking adjournments, the petitioner had filed supplementary affidavit and the pleadings were complete. However, due to

Patna High Court MJC No.3305 of 2015 dt.13-01-2016 2/2 inadvertence, the case was not marked on 03.08.2015 leading to its dismissal.

Learned counsel for the respondents does not oppose.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, the order dated 03.08.2015 passed in C.W.J.C. No. 16199 of 2008 stands recalled.

The writ petition stands restored to its original file and number.

The application stands disposed off.
