The petitioner being the husband of the complainant is languishing in custody since 19.1.2016 in a case registered for the offences punishable under sections 498A and 323 of the Indian Penal Code.

The basic accusation is of torture.

It is submitted by the learned counsel for the petitioner that the petitioner admits his marriage with the complainant and she gave birth to a female child. The petitioner is still ready to keep the complainant with full dignity and honour. Statement to that effect has been made in paragraph 7 of the petition, which reads as follows:

"That the petitioner is ready to keep the complainant/ wife with have dignity and honour which the dissever." Considering the nature of accusation, investigation being concluded, period of custody and the present stand of the

No.32865 of 2016 (2) dt.04-08-2016 petitioner of keeping the complainant with full dignity and honour, let the petitioner, abovenamed, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Banka in Complaint Case No. 73/2010.
