Petitioner seeks bail in a case registered under Section-47(A) of the Excise Act.

137 bottles of country-made liquor are said to have been recovered from Gumti of the petitioner but learned counsel for the petitioner submits that nothing had been recovered from Gumti of the petitioner and as a matter of fact, the petitioner was caught by the Excise Officials from his house and after that they engineered the present case. It is further submitted that prior to institution of the present case, no case of Excise Act had been lodged against the petitioner, who is languishing in jail custody

Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Case No. 117 C-2 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Sheikhpura.
