The petitioner seeks pre-arrest bail in connection with Gopalganj Town P.S. Case No. 745 of 2018 for the offence alleged under Section 498A of the Indian Penal Code. The accusation is of torturing of complainant/informant by her husband through varous modes, due to illicit relation with Ranju Devi and removing her from home along with children asking to live in Ward No. 14. At that time, the petitioner, being brother-in-law, also used to abuse on phone from abroad.
The submission of the learned counsel for the petitioner is that petitioner is the brother-in-law of the complainant/informant and his family members use to reside
Patna High Court CR. MISC. No.60449 of 2019(2) dt.24-09-2019 2/2 separately. Petitioner has falsely been implicated in this case. Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Gopalganj Town P.S. Case No. 745 of 2018 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
