The petitioner Shintu Kumar @ Sinku Kumar apprehends his arrest in Jehanabad SC/ST P.S. Case No. 42 of 2014, registered for the offences punishable under Sections 323, 379 and other Sections of the Indian Penal Code and Section 3(i)(x) of the SC/ST (Prevention of Atrocities) Act. Ram Pravesh Paswan alleged that while his son Rakesh Paswan had gone to see his field the petitioner and others went there and abused him, thereafter, Mutti Singh and Rajkumar Sharma and others went there and assaulted the informant. Learned counsel for the petitioner submits that on account of land dispute and for irrigating the land the occurrence took place. There is no specific allegation against the petitioner. The petitioner is not assailant of anybody.
Patna High Court Cr.Misc. No.52202 of 2014 (2) dt.06-01-2015 Learned APP did not dispute the facts.
Having considered the facts aforesaid and the fact that on account of dispute with regard to irrigating the land the occurrence took place and no specific allegation is made against the petitioner, he above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jehanabad in connection with Jehanabad SC/ST P.S. Case No. 42 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
