The petitioners, namely, Raja Kumar Chaupal @ Raja Chaupal and Katoria Devi, apprehend their arrest in a case under Sections 304(B) and other sections of the Indian Penal Code.
The informant alleged that he married his daughter to Pappu Chaupal on 25.05.2008. The husband of his daughter and the mother-in-law were demanding dowry. Her son-in-law came to his house and took his daughter to his house but again the accused persons began to torture his daughter. The informant was informed by his own daughter. His daughter is still missing. Learned counsel for the petitioner submits that the petitioners are brotherin-law and mother-in-law of the deceased. They have no manner of concern with the family affairs of the deceased. The informant
Patna High Court Cr.Misc. No.40516 of 2015 (3) dt.06-11-2015 2/2 has not made any specific allegations against the petitioners. After seven years of marriage, the case is lodged. The sisters-in-law have already been enlarged on anticipatory bail vide order passed in Cr. Misc. No. 41243/2015.
Considering the facts aforesaid, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Rosera, Samastipur (Bihar) in Bithan P.S. Case No. 31/2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Jha, J) Dilip/- U T
