JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-03-2017 The petitioner is in custody since 31.12.2016 in connection with Kotwali P.S. Case No. 723 of 2016, registered for offences punishable under Sections 370(a)(ii), 120B of the Indian Penal Code and Section 3, 4, 5, 6 and 8 of the Immoral Traffic (Prevention ) Act. 1956.
It has been submitted on behalf of the petitioner that allegation against the petitioner is that during the raid by the police in a hotel/guest house, the petitioner was found in objectionable condition with a lady, however, the petitioner has been falsely implicated in the present case as the said room was booked with the purpose of negotiation of marriage. Moreover, other coaccused having similar allegation has already been granted bail by
Patna High Court Cr.Misc. No.10573 of 2017 (2) dt.21-03-2017 2/3 the court below itself, and this petitioner has been in judicial custody since 31.12.2016 Heard learned A.P.P. also.
Considering the aforementioned facts and circumstances, the period of custody and other co-accused person has already be enlarged on bail by the court below, as such, let petitioner, above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with Kotwali P.S. Case No. 723 of 2016, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioner will not induce any witness or tamper with the evidence.
(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates
Patna High Court Cr.Misc. No.10573 of 2017 (2) dt.21-03-2017 3/3 without showing any genuine reasons, the prosecution is free to move for cancellation of his bail.
