Petitioner happens to be husband of the deceased and according to the prosecution case itself, deceased received burn injury on 09.06.2015 and, subsequently, she was taken to Bokaro General Hospital, where she got admitted but in course of her treatment, she died on 22.06.2015. After death of the deceased, the fardbeyan of the petitioner was recorded on 23.06.2015 in which he disclosed that deceased was caught in fire while she was cooking meal. The inquest report was also prepared in presence of the complainant/informant, who made his signature on the inquest report. However, on 02.12.2015, the complainant/informant filed

Patna High Court Cr.Misc. No.34398 of 2016 (2) dt.20-08-2016 2/2 Complaint Case which was converted into the present case. Submission on behalf of the petitioner is that before filing of the complaint petition, the petitioner gave informatory petition to the Sub-Divisional Judicial Magistrate, Sherghati, Gaya disclosing this fact that the complainant/ informant was making illegal demand.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Sherghati , Gaya in connection with Amas P.S.Case No.196 of 2015.
