The petitioner seeks bail in Muzaffarpur Sadar P.S. Case No. 447 of 2016, registered for the offences punishable under Sections 414, 120(B) and 34 of the Indian Penal Code. The police arrested the petitioner and it is said that from possession of the petitioner one red and white coloured Splendor motorcycle bearing Registration No. BR-06AU-3488 was recovered.

Learned counsel for the petitioner submits that the petitioner has got one case. The motorcycle was not recovered from the possession of the petitioner rather the motorcycle was parked there from before and the police falsely implicated the

Patna High Court Cr.Misc. No.12494 of 2017 (2) dt.23-03-2017 2/2 petitioner showing false recovery of the motorcycle. The petitioner is in jail since 14.08.2016.

Considering the facts aforesaid and the fact that the petitioner has already remained in jail for about seven months, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Muzaffarpur in Muzaffarpur Sadar P.S. Case No. 447 of 2016.
