JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 29-03-2023 The instant appeal has been listed under the heading 'To Be Mentioned' at the instance of learned counsel for the appellant to correct some typographical mistake. By order dated 22.03.2023, the appellant was granted regular bail by this Court.
It is submitted by learned counsel for the appellant that in the fourth line of paragraph-3, it has wrongly been typed as "against the refusal of prayer of anticipatory bail", which should be read "against the refusal of prayer of regular bail". Further, in the second line of seventh paragraph, it has wrongly been typed as "in the event of his arrest or surrender" and in the second last line of seventh paragraph the sentence "subject to
Patna High Court CR. APP (SJ) No.3811 of 2022(6) dt.29-03-2023 2/2 the condition as laid down under Section 438(2) of the Cr.P.C." but the fact is that the instant appeal has been filed for grant of regular bail and the aforesaid two lines may be deleted from the order dated 22.03.2023.
In such view of the matter, the order dated 22.03.2023 granting bail to the appellant is rectified to the extent as indicated above and be read accordingly alongwith this order. Rest of the order shall remain intact.
