The petitioner is in custody in a case registered under Sections 399 and 402 of the Indian Penal Code and Sections 25(1b)a, 26 and 35 of Arms Act. The informant has alleged that from the possession of the petitioner one loaded country made pistol, one live cartridge and two mobiles were recovered.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 25.4.2015. Charge sheet has been submitted in this case. There is no allegation of tampering with the evidence against the petitioner. The allegation against the petitioner is of recovery of one loaded country made pistol and

Patna High Court Cr.Misc. No.38593 of 2015 (3) dt.08-10-2015 2/2 one live cartridge.

On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Mohd. Inam Khan, learned J.M., 1st Class, Patna in Digha P.S.Case No. 121 of 2015.
