The petitioner seeks bail in Kotwali (Barari) P.S. Case No. 609 of 2016 registered under Sections 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act. The informant alleged that that Bagru Yadav (petitioner), Karu Yadav and Bharat Yadav were quarelling with Tinku Yadav and Rinku Yadav. On the order of the petitioner and Bharat Yadav, Karu Yadav opened fire on Tinku Yadav and Rinku Yadav which hit on the waist of the informant and subsequently he fell down.

Learned counsel for the petitioner submits that there is no allegation of firing against the petitioner. The petitioner is an order giver and for that the petitioner is in jail since 15.12.2016.

Considering the facts aforesaid and the fact that the petitioner being the order giver is in jail since 15.12.2016, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Kotwali (Barari) P.S. Case No. 609 of 2016.
