The present application has been filed on behalf of the petitioner for restoration of Cr.W.J.C. No. 1169 of 2012, which was dismissed for want of prosecution, vide order dated 04.03.2013.
It is contended that on 04.03.2013 due to inadvertence, daily cause-list could not be marked by the advocate's clerk and as such, the counsel failed to appear before the Court when the matter was called out.
Patna High Court MJC No.2638 of 2013 (2) dt.07-10-2015 2/2 On the facts and in the circumstances, the prayer is allowed.
Let Cr.W.J.C. No. 1169 of 2012 be restored to its original file.
