JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section 307 and other minor Sections of the Indian Penal Code. Petitioner is said to have assaulted the informant as well as her daughter and some others by means of Fasuli. The informant sustained, altogether, six injuries out of which opinion regarding one injury, which was found on her left hand between index finger and thumb, was kept reserved whereas rest injuries were found simple in nature. Simiarly, injured Vikas Kumar sustained two injuries and opinion regarding the injury which was found on his right hand was kept reserved. So far as injured Laxmi Kumari is concerned, she, too, sustained altogether seven injuries

Patna High Court Cr.Misc. No.33863 of 2016 (2) dt.18-08-2016 2/2 and except one injury, all the injuries were found simple in nature. However, the impugned order does not reveal that any x-ray report regarding injury no.1 of the informant was produced by the I.O. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Saran at Chapra in connection with Baniyapur P.S. Case No.85 of 2016.
