JUSTICE SUDHIR SINGH ORAL ORDER 12-10-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 392 of the Indian Penal Code.

Allegation against the petitioner is that his car dashed the motorcycle of the informant. As a result, he fell down and thereafter petitioner along with another person assaulted informant and snatched money, mobile sets and A.T.M. cards from him. It has been submitted on behalf of the petitioner that he is in custody since 4.4.2015. Chargesheet has been submitted in the case. There is no allegation of tampering of evidence against the petitioner. Petitioner is not named in the F.I.R. He has not been put on T.I.P. to ascertain his implication in the present case. There is no recovery of any incriminating article from possession of the petitioner. Petitioner has been made accused on the basis of confessional statement of the co-accused.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Case no. 17 of 2015.
