JUSTICE SANJAY PRIYA ORAL ORDER 18-04-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Dalsing Sarai (Ghatho) P.S. Case No. 03 of 2017 instituted for the offence under Section-414 of the Indian Penal Code.

It has been submitted that petitioner has no criminal antecedent. The name of the petitioner has been disclosed by coaccused Ajay Kumar Sah from whose possession, the alleged motorcycle was recovered by the police. It is mentioned in the written report itself, that Ajay Kumar Sah disclosed that he has purchased the motorcycle from Bir Bahadur Rai for Rs. 1800/-. through this petitioner. It has been submitted that co-accused namely, Bir Bahadur Rai has already been granted bail by a coordinate bench of this court vide order dated 04-04-2017 passed

Patna High Court Cr.Misc. No.11946 of 2017 (3) dt.18-04-2017 2/2 in Cr. Misc. No. 15889 of 2017. The petitioner is in custody since 07-01-2017.

In such circumstances, the prayer for bail is allowed and the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Dalsing Sarai (Ghatho) P.S. Case No. 03 of 2017 to the satisfaction of learned Additional Chief Judicial Magistrate, Dalsingsarai subject to condition that both the bailors should be close relatives of the petitioner.
