The petitioners seek bail in Pasraha P.S. Case No. 102 of 2016, registered for the offences punishable under Section 308 and other Sections of the Indian Penal Code. Later on Section 302 of the Indian Penal Code was added after death of Mina Devi. The informant made omnibus and general allegation of assault against the petitioners and other accused persons. During course of investigation, it transpired that Savita Devi and Sheela Devi who were earlier accompanying Mina Devi to the disputed land said that Rajendra Singh assaulted Mina Devi with bamboo stick on her head. Consequently Mina Devi died. The petitioners are alleged to have assaulted Banarsi Singh and others. Banarsi
Patna High Court Cr.Misc. No.12463 of 2017 (3) dt.18-04-2017 2/2 Singh got fracture injury in his hand and others got simple injuries. It appears that there is land dispute between the parties and there is a counter version. The petitioners are not the assailant of the deceased Mina Devi.
Considering the facts aforesaid the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate IInd, Khagaria in Pasraha P.S.
