JUSTICE SANJAY PRIYA ORAL ORDER 20-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Goraul P.S. Case No. 136 of 2012, G.R. No. 1843/12 instituted for the offence under sections 341, 323, 504, 353/34 of the Indian Penal Code. It is alleged that the petitioner is not named in the FIR. His name has come in the supervision note. In the written report, it is alleged that three persons arrived on a Bolero vehicle and altercated with the gate man for opening the gate of railway crossing.

The petitioner is not named in the written report. From the impugned order of the learned Sessions Judge, it appears that there is no any substantive material against this petitioner.

Patna High Court Cr.Misc. No.11624 of 2017 (2) dt.20-03-2017 2/2 Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioner is allowed. In the event of surrender/arrest of the petitioner(s) named above, within six weeks from today, in connection with Goraul P.S. Case No. 136 of 2012, G.R. No. 1843/12, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate,-IVth, Vaishali at Hajipur, subject to the conditions as laid down under Section 438(2) Cr.P.C.
