2. The petitioner apprehends arrest in connection with Panchanpur P.S. Case No. 47 of 2025 dated 01-03-2025, instituted under Sections 126(2), 115(2),109,76, 352, 351(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023. 3.The prosecution case, in short, is that on 12.02.2025 at about 4:30 PM, while the informant was sitting at her house with her bhabhi, the petitioner along with co-accused Sunil Yadav, Munna Kumar, Vinod Yadav, and Ashok Yadav, armed with danda, rod, and pistol, forcibly entered her house. They abused her and threatened to kill her if she appeared in court to depose in a rape case. When she insisted on giving evidence, coaccused Sunil Yadav assaulted her, on account of which, blood
Patna High Court CR. MISC. No.63141 of 2025(2) dt.10-09-2025 2/3 started oozing out, whereafter co-accused Munna, Vinod, and Ashok Yadav also assaulted her with rod and lathi. She sustained serious injuries and when her sister-in-law tried to record the occurrence on her mobile phone, the accused persons fled away threatening with dire consequences.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in the present case. It is further submitted that there is no specific allegation of assault against the petitioner; rather, the allegations levelled are general and omnibus in nature. It is further submitted that there is a case and counter-case between the parties. Earlier, the petitioner had lodged Panchanpur P.S. Case No. 33 of 2025 dated 15.02.2025 against the informant and her family members and subsequently, the present FIR has been instituted against the petitioner on 01.03.2025 by way of counter blast. It is further submitted that the specific allegation of assaulting the informant on her head with the butt of a pistol is attributed to co-accused Sunil Yadav. Lastly, it is submitted that the petitioner has no criminal antecedents.
5. Learned APP has opposed the prayer for bail.
6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in

No.63141 of 2025(2) dt.10-09-2025 3/3 the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM VIII, Gaya in Panchanpur P.S. Case No. 47 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita 2023.
