JUSTICE BIRENDRA KUMAR ORAL ORDER 26-11-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 406/420/323/504/506/34 of the Indian Penal Code. The informant was tenant in the house of the petitioners. On the persuasion of the petitioners, the informant deposited money in Weird Infrastructures Corporation Limited to get double benefit. Subsequently, the company fled away when the informant demanded refund of the money the petitioners and others committed assault.

Submission is that the petitioners were also cheated by the said company as they all also invested money, which would be evident from debenture certificate issued by the company in the

Patna High Court Cr.Misc. No.33738 of 2016 (3) dt.26-11-2016 2/2 name of petitioners. Some other different customers including the petitioners lodged case against the said company. Considering the aforesaid facts, let, the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra/Successor Court in connection with Chhapra Town P.S. Case No.172 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
